The FDA just sent out it's 10,000th letter to brick and mortar tobacco stores, as well as targeting 4 popular online tobacco retailers: BNB Tobacco, RSB Tobacco, Tobacco Outlet Express, and Golden Valley Tobacco.

believe this to just be the beginning of a much larger push towards reclassification.

It was only a matter of time once they started repackaging pipe tobacco as "dual use" to get around Obama's RYO cigarette tobacco tax hike. It was too obvious the way pipe tobacco sales exploded. I worry about whole leaf once they start to see tax revenues drying up. Home growers are now ahead of the curve.

However, personally I wouldn't be concerned about leaf tobacco for at least 5 years. As evidenced by the "pipe tobacco" fiasco, it will likely take the feds at least that long to run their numbers and take action on any major shift. Even so, since leaf sales are not tracked or reported, it will be inherently difficult for them to take enforcement action. Beyond that, they can't just arbitrarily tax leaf tobacco without putting severe strain on every tobacco farmer in the U.S. - which would surely rile up Philip Morris, RJ Reynolds, etc.

Personally I believe our country is going to look much different in 5 years time given the financial problems and war drums of today, but those thoughts would be best reserved for a different thread. Suffice it to say - I'm not worried that leaf tobacco is going to be on any government agency's list of priorities in the near future. :)

Excerpt from one of the letters:

Specifically, in your “Pipe Tobacco” section of the website, you promote these product brands for sale with cigarette-injector machines or as part of roll-your-own starter packages or starter kits, which include tobacco, cigarette tubes, and a cigarette machine. This presentation suggests that your products are intended to be used to make cigarettes with the cigarette machines and cigarette tubes with which you promote them. Because the overall presentation of your products, which consist of loose tobacco, suggests that they are intended for use in cigarettes, they meet the FD&C Act’s definition of “cigarette tobacco.”

I think it was originally determined by the cut. Once their tax revenue took a hiatus, I'm sure they redefined some definitions.

alert online retailers will (should) promptly change their "starter kits" so that they include only a small bag of "cigarette tobacco" so presentation is no longer an issue.

But they ant worried about gettin tax from pot that they have decided with out a law was ok. We need laws that are concreate. Wishy washy laws are a very bad thing.

I'm good to go for a few years. Now that I'm over the hump, it shouldn't be that hard to stay that way. Now if they raise the tax, they're giving me a pay raise. I'll decline to comment about men or women.

2 years with out bamar care an the IRS puts a tax lean on your house. It looks like mine will be $4000 a year. I guess its time to retire and jump on the wagon.

Not really, I'll start stuff in person that I wouldn't start here. It's too hard to walk away from it here. My wife doesn't ask questions that she doesn't want answered. Either she knows the answers by now or prefers the peace and quiet.
