Just got a call from the State of Washington dept. of liquor control. He asked me if I was licensed to sell tobacco in the state of Washington. I told him I wasn't obligated to, nor was there a federal license that could be obtained to do so. I explained that under federal law, people are allowed to make tobacco products for personal use...just like making beer. He told me making beer for personal use in the state of Washington was illegal as was growing and manufacturing tobacco for personal use.

I asked him if he could tell me what article number in the Washington State revised code prohibits residents from growing tobacco and he said there were "umpteen thousands of codes and he couldn't tell me which one".

Explain to the nice bureaucrat that Federal Law trumps all State law and to have a nice day. Use to live in that God forsaken socialist state, cigars bad...weed good??

It sounds like the states think they can get away with making things inconvenient for people. That is nothing less than malicious prosecution.

That doesn't sound right. Some bureaucrats need reminding of their "civil servant" status. He should have been able to provide you with an answer.

And, based on the news, they should have bigger fish to try out there, like actually implementing a regulatory and tax structure for the weed business which is or now should be legally operating. If they want to stop actual crime, they could start there and hasten the demise of the smuggling cartels.

States are allowed to further regulate the production and transportation of homemade beer and wine.

Washington State provides an exemption for homemade beer and wine in RCW 66.12.010 allowing production without a license or permit. This makes home brewing and wine making legal in Washington!

I wonder why he would even bother to call you. How would he know if you ship to Washington state.
Doesn't he have pot growers to hassle out there.

Kind of funny way of showing his ignorance, since you do not sell any "tobacco products". but rather an "agricultural comodity".

The Chief of Police drove by my patch and asked me what I was growing. I said, "tobacco."
He said: "Is it legal to grow tobacco in Mississippi?" I said "sure" and quoted off a bunch of numbers, Like, MS Code 245sdf 2345678910too. He said "Well good luck". Those kind don't need to HATCH! Gmac

Gonna be real interesting to see how this pans out.

1) Are there any actual legitimately applicable WA state laws...
2) Who went through the effort of buying from you and then "turning you in" to some liquor control dude. I assume it wasn't a legit customer but just someone playing junior FBI man.
3) How he's going to enforce across state lines.
