Smokers have to pay higher insurance premiums. If you lie and say you don't smoke to get out of paying extra, you're guilty of fraud. They can either deny coverage or make you pay the extra that you should have been paying, including "back pay". One more intrusion of the gov't or insurance companies into our private business.

I'm covered by my wife's insurance from work. It costs me $90.00 more per month because I'm a smoker. My guess is that the insurance companies, or the gov't thru Obamacare, are forcing providers to look for fraud at "point of use" if they want to get paid.

If this should be a government mandate through Obamacare, it is just another sign that the U.S. Constitution is becoming a meaningless scrap of paper. If this tobacco breathalizer test were directly administered by the government, then it would be an "unreasonable search." The constitutional loophole might perhaps be that it isn't a government agent administering the test, but an allegedly private practitioner, at the bequest of an allegedly private insurer.

P.S. Aside from the fact that lying would be committing insurance fraud, it is a bad idea to conceal a health fact such as smoking from one's doctor, as this is information that your doctor needs to know.

Proving fraud would be nearly impossible unless there is a clause in your policy that requires you to inform the insurance company if you START using tobacco.

What's your best guess as to why they are checking for smokers at a dentists office rather than taking the patients' word for it?

Just because you go to the dentist and they ask you to breath into a ring, or even to pee into a cup you DO NOT have to oblige them. I always am asked by my dentist if I would like an oral swab test to test for mouth cancer. I turn them down politely.

BTW, I bought half a dozen "nicotine pee sticks" off E-bay awhile ago. These are the things a lot of medical people use to determine if you smoke. You pee on the thing (or if your a woman you pee into a cup, then dip the thing into the cup then spend 15 minutes washing your hands) and then look for a color change. I've determined (for me) that it takes 3 days of no tobacco for the stick to declare that I am not a smoker. They were cheap too, something like $2.00 apiece.

I offered my brother-in-law one of my home rolled cigars and he said he would love one but politely had to decline. His new life insurance policy is "zero tolernce" to get the best rate. ANY trace of smoking would turn him into a "smker" and VOID his policy. If he smoked a cigar then had an accident, the autopsy would void his policy and leave nothing for his family; even though tobacco had nothing to do with his death.

My life insurance policy didn't ask about tobacco use -- and the premium was better than the alternatives I checked out.:D You can get better deals in life insurance from fraternal organizations than from the big national insurance companies, you just have to find them.

That makes me laugh for reasons not explainable. No one should be worth more dead than alive, period. But if thats the way it is than you should name a beneficiary to all your worldly tobacco stuff. Heh heh.
