1. BC Provincial Sales Tax Act acknowledges the existence of raw leaf tobacco as a category.

2. Canada Excise tax act acknowledges raw leaf tobacco as a category.

This is proof that the BC Excise Tax Act's use of loose tobacco and the fact they did not state raw leaf anywhere, is intentional.

In summary. The province has "raw leaf" as a category. They intentionally say "loose". They intentionally do not say "raw leaf".

I've posted in two threads on this topic now. I feel for y'all. I wish this wasn't happening. I have to unfortunately bow out and let you all advocate for yourselves. I don't work for WLT, and I'm really busy doing my masters, so I think I'm going to bow out of these three conversations. Please don't share too much ambiguous, catastophizing unconfirmed info.

I spoke with someone with more information than I've been able to find and was told the "code word" has been changed for "unmanufactured leaf tobacco" to "raw tobacco" or "raw leaf tobacco". All customs forms will be edited to reflect the new code word in hopes of getting the leaf through customs without issue.

This is from the form that we get from WLT and the Canadian government website, so unless they have rewritten this or created a new law to reflect the "raw tobacco" name change we still have a problem I believe.
I don't think we can just change the wording on the form without the proper law stated on the form. We need to know what new laws they are using to charge the PST on the leaf.

Canada Border Services Agency Chapter 24 T2015 2401.10.99 unmanufactured tobacco.
Tobacco not stemmed or stripped 5.5%
Canada Revenue Services 7.1.1 chapter 10.
According to paragraph 25(3)(a).
An individual who is not a tobacco licensee may manufacture tobacco from raw leaf tobacco on which excise duty has been paid, provided that the tobacco is for the individuals personal use.

Does anyone have a form from their last order that made it through so we can compare to the posted one?

I just spoke to the BC tax folks and they say that there's a 65¢ per gram tax on all tobacco products for BC - which includes whole leaf tobacco. They are emailing me the relevant information.
that law came into effect in the summer of 2022, and has never been charged to me
Strangely, I ordered another 2lbs at the end of January and this has an even higher duty of $747
So I’ve sent both back to CBSA with the reassessment form and now it’s a wait & see game. Both by orders were assessed in ON so I’m wondering if that had anything to do with it
Guess I’ll find out in the next month what’s going on

Let me know if that works. My reassessment form didn’t work.
Sorry, that is an old form I had filled out a couple of years ago to keep as a reference.
My last order was received December 10 2023 and there was no extra PST charge, six pounds $26.08.
I didn't keep the customs form, too bad I would have liked to take a look at it now.

I didn't keep the customs form, too bad I would have liked to take a look at it now.
That sounds like what it should be. Hopefully it gets resolved. My order was December 27 2023.

They are calling it PST but it's actually the excise tax rate on loose tobacco. They just are being lazy about reporting it.

I ordered Jan 8th 2024, package had 708$ duty charged for 2lb. Told my local post office to send it back for reassesment. Now Canada post is saying I refused the package. I'm not sure if this was a mistake from the local postal workers, or if Customs Canada is simply trying to cost me money in shipping by sending my package back in a hope to discourage me. Has anyone gotten a successful package in Canada (especially BC) since the new year rolled over?

I would like to add that WLT has been very helpful through this whole mishap. Great customer support.

You did refuse the package. That's what you're supposed to do. Refuse and send for reassessment.
Okay, so I guess that's what I did and now the tracking says its heading back to sender. I told the man at the post office that if it gets sent back to WLT I'll have to pay shipping twice so I doubt he's the one to blame.
